General Terms and Conditions of Sale

These General Terms and Conditions of Sale govern all transactions with Saunamo / Arbor Eco LDA, identified by tax number PT517939126, registered office at Rua Hermano Neves, Nº 18, Piso 3, Escritório 7, V2474, 1600-477 Lisbon, Portugal.

By placing an order with Saunamo, the customer agrees to these terms unless a different agreement is made in writing.

Parties Involved

Supplier:

Saunamo / Arbor Eco LDA, NIF PT517939126, Rua Hermano Neves, Nº 18, Piso 3, Escritório 7, V2474, 1600-477 Lisbon, Portugal.

Customer:

The individual or company placing an order with the Supplier.

Applicability

All transactions are governed by these terms and conditions. For matters not covered by these terms, the United Nations Convention on Contracts for the International Sale of Goods (CISG) applies automatically.

Evidence and Documentation

Before placing an order, the Customer is presumed to have reviewed all relevant documentation available on the Saunamo website, including product descriptions, technical specifications and assembly instructions. This includes any materials sent to the Customer by other means, such as email or telephone. The Customer should keep copies of all communications and documents related to the order.

Cancellation Policy:

14-Day Cancellation Period:

The Customer has 14 days from the order date to request cancellation and receive a full refund.

Cancellation After 14 Days:

If the Customer cancels after 14 days, no refund will be issued, as production will already have started and costs incurred.

Cancellations after production:

Cancellations made after the product has been manufactured carry a restocking fee of 50% of the product price.

Returns:

The Customer must return the product in its original condition and packaging. Return shipping costs are the Customer's responsibility. Refunds are only issued once the item is received. If the product is not in its original condition, the refund does not apply.

Conditions:

All cancellation requests must be made in writing. This policy does not affect your statutory rights regarding faulty or misdescribed products.

Delivery

Estimated delivery dates are provided at the time of ordering, subject to stock availability. Shipping costs are separate from the product price. The Customer must ensure availability at the time of delivery; any additional costs caused by absence are borne by the Customer. Products must be inspected on delivery, with any defects or missing parts reported within 10 days. Claims do not release payment obligations.

Payment Methods

Advance and Final Payment:

An advance payment of 50% is required to confirm the order, with the balance due before delivery via bank transfer, credit card or cryptocurrency.

Non-Compliance:

Failure to comply with payment terms will incur interest as set by applicable law.

Conformity and warranty against defects

The Customer must ensure that the technical product descriptions match their needs, reporting any non-conformity within 10 days of receipt. The Supplier offers a 3-year warranty against defects in wooden structures, subject to specific conditions: the warranty covers manufacturing defects only and does not include natural wear caused by the elements. This includes the natural expansion and contraction of wood, which shrinks and swells when exposed to heat and humidity. The Customer is responsible for the proper treatment of materials against rot, mould, insects, humidity, heat and other elements. The warranty does not cover defects resulting from installations carried out by third parties not recommended by the Supplier. The Customer must provide evidence of the defect through photos, videos or live demonstrations. The warranty is only activated once sufficient evidence is provided that the defect is due to a manufacturing error. The Customer must provide the product serial number to activate the warranty. The warranty is intended to repair manufacturing defects and installation errors made by the Supplier. The product will only be fully replaced if it is deemed unusable. The warranty claim process begins by contacting the Supplier in writing and submitting evidence of the manufacturing defect. The Supplier reserves the right to process the warranty claim within 6 months of receipt.

Termination of Sale for Non-Compliance

The Supplier reserves the right to terminate the sale if the Customer fails to meet their obligations after notification.

Final Provisions

Copyright:

Drawings and installation documents remain the exclusive property of the Supplier.

Data Protection:

The processing of personal data complies with the GDPR.

Jurisdiction:

Disputes will be resolved in the courts of the jurisdiction where the Supplier's company is registered.

Price Fluctuations:

Prices may vary due to raw materials markets, allowing the Supplier and Customer to propose and accept new prices or cancel transactions.

Building Regulations:

The Supplier accepts no responsibility for obtaining building permits or for compliance with local building regulations. All necessary permits must be obtained by the Customer before the Supplier is instructed to facilitate installation. Customers are strongly advised to seek local advice and guidance on building regulations before installation.

Assembly:

The Supplier is not responsible for issues related to assembly, except for installation defects directly related to the item purchased. All technical teams employed by the Supplier for installation are responsible for their own insurance, covering installation-related accidents.

Please note that assembly does not include any electrical connection, which must be carried out by a certified electrician. Wood-burning heater installation is, however, included. Saunamo / Arbor Eco LDA accepts no responsibility for any electrical connection of any sauna unit, including but not limited to the heater and the lighting.

Storage:

Additional fees apply after two months of free storage, with a maximum storage period of 6 months.

These terms govern all transactions between Saunamo and its Customers, ensuring clarity and fairness in our commercial relationships.
